User Agreement of Terms and Conditions
PocketMore Inc. ask that you carefully read all the terms and conditions stated in this agreement prior to enrolling as a “user” of this “site”. A “user” under this agreement shall be any individual who meets the enrollment terms and registers on PocketMore.com. PocketMore Inc. shall be known in this agreement as “PocketMore.com” or “site”. The cash back rewards and Share forum shall be known as the “program”. A user who registers on this site shall be bound by the terms and conditions of this site and has read, understood and agreed to said terms and conditions. Enrollment and participation of the program and all its benefits are controlled and offered at the discretion of PocketMore and PocketMore has the right at any time without notice, to change or modify the terms and conditions set forth in this agreement.
Program Participation
You as a user have the ability to earn and accumulate cash back rewards in the form of money rebates payable by paper check, paypal or electronic check processing (ECP). The terms and conditions in this agreement are established in an attempt to explain the rights and responsibilities of both the user and PocketMore.com and to provide a fair and equitable experience for both parties. A user is under no obligation to participate in, or derive any benefits from, the program. PocketMore.com offers the program free to all qualified users. Users of this site are automatically credited with cash back rewards when a qualified purchase is made through this site to a participating merchant according to the terms and conditions specified by both this site and the merchant. Not all merchants listed on this site qualify for a cash back reward. Please note that some merchants have restrictions or requirements to earn cash back rewards. Cash back rewards are based on a percentage of the net purchase of the user. Percentages relate to either the merchant store or in some cases, the ad link on this site. The net purchase is defined as the total amount paid to the merchant less; tax, transaction fees, credits, shipping, gift wrapping, special services, promotions or other designations specified by the merchant or this site. Final determination whether or not a purchase made through a qualifying merchant is valid is at the sole determination of PocketMore.com. In the case of returns, cancellations or other events, PocketMore.com retains the right to reverse account credits. Should the user disagree with any adjustments by PocketMore.com, the users sole remedy is to cancel their participation with the program. PocketMore is not responsible for tracking problems as a result of misuse of the program, disabling cookies, operating system or browser issues, third party software, merchant site issues, merchant errors/omissions or any other tracking failures.
Enrollment
To qualify for eligibility in this program, the following conditions generally must be met. Failure to meet these conditions may result in not receiving cash back rewards or cancellation of enrollment. This program is only offered for purchases made through links available on this site.
- The user must be 18 years of age or older.
- The user must have cookies enabled. (Both first (and third if applicable))
- The user must first register a free account with PocketMore.
- The user must have Internet access.
- The user must have a valid email address.
- The user must sign-in or log-on to the site.
- The user must successfully link to a merchant store through the site.
- The user must make a qualifying purchase with the merchant via the site link.
- The user must the qualifying purchase in one shopping session, completing the purchase in a different session may invalidate your eligibility for a cash back reward.
- The user must fully complete the transaction.
- You must reside in the United States of America or Canada.
- The user must be human and no programs, software or other media may be used to navigate the site for financial or other benefit.
Failure to receive cash back rewards may include but are not limited to:
- Failure to meet the criteria above
- Failure to meet the terms and conditions of the merchant.
- Failure of tracking transmissions
- The user changing the URL’s
- Violation of any term of this agreement or unethical action in relationship to this site outside of this agreement.
- Certain “coupons” and “no discount” links and/or items may not qualify for cash back rewards.
Robots
The user agrees that the user will not use any robots, spiders, crawlers or other automated downloading programs or devices to:
(i) continuously and automatically search or index any Content, unless authorized by us; (ii) harvest personal information from the Site for purposes of sending unsolicited or unauthorized material; or (iii) cause disruption to the working of the Site. If this Site contains robot exclusion files or robot exclusion headers, you agree to honor them. (iv) Any attempt to bypass robot exclusive headers or other program placements we use to restrict or prevent access to this site. Any questions about whether a particular use is authorized and any requests for permission to publish, reproduce, distribute, display or make derivative works from any Content should be directed to support@pocketmore.com.
User Account
Upon program registration of a user name and password, an account will be established in the users name. This account will allow user to access to track transaction, edit profile information, request payment, and other pertinent information. PocketMore is not responsible for changes, credits or debits made to a user’s account as a result of an unauthorized access nor is PocketMore liable for losses or liabilities as a result of. PocketMore is entitled to act on instructions as a result of the correct entry of a users name and password. The user is responsible for maintaining accurate account information at all times. Changes to contact or location information should be made as soon as reasonably possible. Failure to do so may result in the inability for the user or PocketMore to process cash back rewards or other benefits. User is also responsible for monitoring accurate account balances and transaction records. Discrepancies should be reported to PocketMore within 60 days. Accounts will be deemed accurate if discrepancies are not reported to PocketMore within 60 days. Discrepancies must be reported to support@pocketmore.com.
Redeeming Cash Back Rewards
The users earned cash back rewards will be posted to the users account within 30 days from the date that the participating merchant reports the transaction to PocketMore.com. The user should not be concerned if they do not see the transaction reported prior to 30 days. The user should not contact PocketMore.com in regards to posting this data to the users until 30 days are past. The transaction will initially be listed under the users “pending” section of the account. The transaction will remain in pending for a period of ninety-one (91) to one hundred and twenty-one (121) days. This period of time is in accordance with the merchant’s right to reverse a transaction for return or cancellation purposes. When a merchant authorizes the payment of the transaction, then PocketMore.com will convert your pending amount from that transaction to the “available” section of your account. At this time the user may request payment for the available amount of the cash back reward. User must manually redeem any available amount of cash back reward. There are no automatic or recurring payments to users. Request for payment must be made through the users account page. In order to redeem available amounts of cash back rewards less than $20.00, the user must have an account with Paypal or accept a payment directly into your bank account via Electronic Check Processing (ECP). In order to receive payments by ECP, the user must fill out the bank deposit information on the users account page. For more about ECP, see EPC info. For amounts $20.00 or greater, the user may request payment via Paypal, ECP or mailed paper check. Payments will be made within 30 days from the time PocketMore.com receives request for payment from the user. PocketMore is not responsible for lost mail or any other event that would prevent the user from receiving their cash back reward that is outside the control of PocketMore.com. The user shall be solely responsible for any and all tax liabilities incurred from receiving cash back rewards.
General
PocketMore.com is not responsible for changes to, or discontinuance of, any qualifying Merchant, any qualifying Merchant’s withdrawal from the program, or for any effect on accrual of cash back rewards caused by such changes, discontinuance or withdrawal. No benefit or cash back rewards received by the user under the program my be assigned, transferred or exchanged to any third party, unless expressly permitted by PocketMore.com or allowed in the terms in relation to a function of the program. User is prohibited from selling, lending, transferring, exchanging, pooling or bartering any cash back rewards in the program unless permitted in writing by PocketMore.com. Cash back rewards being sold or otherwise dispersed in violation of the terms and condition may be forfeited, confiscated or cancelled. Cash back rewards have no cash value until such time as the user request and receive payment in accordance with the terms and conditions of this agreement and the user shall have no property rights or other legal interest in PocketMore.com Cash back rewards. It is the responsibility of the user to verify that all coupons, discounts, codes special pricing, special offers is valid and present when completing the purchase at checkout with any qualifying merchant. All offers and promotions are subject to change without notice.
Termination
PocketMore.com reserves the right to terminate the Program at any time, in whole or in part with notice. Should PocketMore.com terminate the program, the user will have 150 days from the date of notice to redeem any available cash back rewards. This time period will allow all pending amounts that have accrued to be transferred to the users available funds account. PocketMore.com will send notice to the users email address specified in the users account. PocketMore.com will not be responsible for failing to notify the user of program termination if the failure is caused by any reason outside of the control of PocketMore.com. Such failure may include but not be limited to, errors in your email program, and inaccurate email, failure of the user to check emails, or failure of the user to update email address information within the users account on PocketMore.com. The terms and conditions of this agreement may change without notice. It is the responsibility of the user to check for modifications to this agreement. If the user disagrees with the terms set forth in this agreement or with any changes made to this agreement, the user must immediately terminate participation in this program.
Limitations on Liability and Disclaimers
Use of Online Coupons. PocketMore.com provides online coupons as a free service to its Users. PocketMore.com is not responsible for the redemption, errors/omissions or expiration of online coupons and it is your responsibility to make sure that a discount, special pricing, or free offer is present in the checkout process of a Qualifying Merchant. All offers and promotions on this site are subject to change without notice. PocketMore.com has no control over the legality of any coupons or other offers made by Qualifying Merchants, the ability of any of the Qualifying Merchants to complete the sales in accordance with the offers, or the quality of the goods offered by the Qualifying Merchants. PocketMore.com has no control over whether Qualifying Merchants will honor the offers shown on PocketMore.com, and does not guarantee the accuracy or completeness of the information contained on the website. In the event you have a dispute with a Qualifying Merchant in any way relating to the PocketMore.com website or the use of information from the website, you agree to waive and release PocketMore.com from any and all claims, demands, actions, damages (actual and consequential), losses, costs or expenses of every kind and nature, known and unknown, disclosed and undisclosed relating to that dispute.
PocketMore.com IS BEING PROVIDED BY PocketMore.com "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETMORE.COM DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO POCKETMORE.COM. INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. YOU AGREE THAT POCKETMORE.COM WILL NOT BE LIABLE FOR ANY COSTS OR DAMAGES ARISING OUT OF A DISPUTE BETWEEN YOU AND ANY QUALIFYINGD MERCHANT, AND YOU HEREBY EXPRESSLY WAIVE ANY SUCH CLAIM AGAINST POCKETMORE.COM AND ITS MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, PARENTS, SUBSIDIARIES, AGENTS AND REPRESENTATIVES. POCKETMORE.COM DOES NOT MAKE ANY REPRESENTATIONS OR GUARANTEES REGARDING ANY GOODS OR SERVICES OFFERED OR PROVIDED BY QUALIFYING MERCHANTS OR SUPPLIERS. POCKETMORE.COM DOES NOT MAKE ANY REPRESENTATIONS THAT ACCESS TO THIS SITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND POCKETMORE.COM ASSUMES NO RESPONSIBILITY FOR ANY DAMAGE CAUSED BY YOUR ACCESS, OR INABILITY TO ACCESS, THIS SITE, INCLUDING, BUT NOT LIMITED TO, YOUR INABILITY TO RECEIVE POCKETMORE.COM CASH BACK BY PURCHASING ITEMS WITH A PARTICIPATING MERCHANT.IN NO EVENT SHALL POCKETMORE.COM BE LIABLE FOR ANY DAMAGES, CLAIMS OR LOSSES INCURRED (INCLUDING WITHOUT LIMITATION COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES), HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY ARISING IN CONNECTION WITH YOUR USE OF POCKETMORE.COM; ANY ACT OR OMISSION BY POCKETMORE.COM IN ADMINISTERING THE WEBSITE OR THE PROGRAM; OR THE PURCHASE OR USE OF ANY GOODS OR SERVICES OF MERCHANTS OR SUPPLIERS, EVEN IF POCKETMORE.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, OR LOSSES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. NOTWITHSTANDING THE FOREGOING, IN NO EVENT SHALL PocketMore.com BE LIABLE TO YOU FOR DIRECT DAMAGES CAUSED BY POCKETMORE.COM IN EXCESS OF THE CASH BACK EARNED BY YOU DURING THE MOST RECENT SIX (6) MONTHS. SOME STATES DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
YOU AGREE TO INDEMNIFY AND HOLD POCKETMORE.COM, ITS PARENTS, SUBSIDIARIES, QUALIFYINGS, OFFICERS, DIRECTORS AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES AND EXPENSES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE OF POCKETMORE.COM, THE VIOLATION OF THESE TERMS AND CONDITIONS BY YOU, OR THE INFRINGEMENT BY YOU, OR ANY OTHER USER OF YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY, OR AS A RESULT OF ANY THREATENING, LIBELOUS, OBSCENE, HARASSING OR OFFENSIVE MATERIAL CONTAINED IN ANY MEMBER COMMUNICATIONS.
THE "TERMS AND CONDITIONS" SET FORTH WITHIN THIS AGREEMENT MAY CHANGE FROM TIME TO TIME; POCKETMORE.COM WILL POST THOSE CHANGES ON THIS PAGE. YOU CONSENT TO BE BOUND BY ALL THE SAID "TERMS AND CONDITIONS," INCLUDING ANY AND ALL UPDATES THERETO. POCKETMORE.COM WILL NOT BE RESPONSIBLE IF YOU DO NOT LEARN OF THE MODIFICATION. IT IS YOUR RESPONSIBILITY TO CHECK THIS PAGE OF THE POCKETMORE.COM SITE REGULARLY TO DETERMINE WHETHER THIS AGREEMENT HAS BEEN MODIFIED. IF YOU DO NOT AGREE TO ANY MODIFICATION OF THIS AGREEMENT, YOU MUST IMMEDIATELY TERMINATE YOUR USER NAME, PASSWORD AND REGISTRATION.
You agree to comply with all applicable laws, rules and regulations. You may participate in PocketMore.com if and to the extent that such laws, rules and regulations permit such participation. PocketMore.com may refuse to enroll, restrict, modify or terminate your username, password and registration without liability to you or any other third party if you violate any law, rule or regulation, of if your participation could violate any law, rule or regulation.
5. Proprietary Rights to Content. You acknowledge that PocketMore.com content, including but not limited to: text, sounds, photographs, graphics, or other material contained in any PocketMore.com communication, advertisements or messages, whether by PocketMore.com, PocketMore.com or PocketMore.com's advertiser's or Qualifying Merchants, service and software are protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws. You are only permitted to use content, service, or software as expressly authorized by PocketMore.com, its advertisers and Qualifying Merchants, as the case may be.
6. Termination of Agreement.
- Any violation of the Terms and Conditions of this Agreement is grounds for termination of your user name, password and registration with PocketMore.com.
- PocketMore.com reserves the right to terminate your user name, password and registration, if your account is inactive for twenty-four (24) consecutive months. An account shall be deemed and considered to be inactive if there has not been any PocketMore.com Cash Back earning activity.
- You may terminate your user name, password and registration at any time by sending an email to our 24 Hour Customer Service.
- If your user name, password and registration with PocketMore.com are terminated for any reason, either by you or by PocketMore.com, you shall forfeit any and all earned PocketMore.com Cash Back in your account.
7. Notice. All PocketMore.com notices will be given by email, postal mail, or by general posting to the PocketMore.com website.
8. Waiver. PocketMore.com's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
9. Choice of Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without reference to conflicts of law rules, and you consent to exclusive jurisdiction and venue in the courts located in Dane County, Wisconsin for all matters in connection with this Agreement or your use of PocketMore.com.
10. PocketMore.com reserves the right to terminate your user name, password and registration, if your account has been associated with any legally questionable activity.
11. Severability of Provisions. Any provision (or part thereof) of this Agreement which is found to be invalid, prohibited, or unenforceable, shall be ineffective only to the extent of such prohibition and unenforceable, without invalidating the remainder of the provision or the remaining provisions hereof. To the extent permitted by the applicable law, each of the parties hereto hereby waives any provision of law, which prohibits or renders unenforceable any provisions hereof in any respect.
